Remember back in January when Halle Berry's husband, Olivier Martinezallegedly assaulted an LAX employee after surrounding paparazzi got too close for comfort? Just as a refresher, TMZ obtained video of the incident showing Halle and Olivier swarmed by paparazzi after landing at LAX. Olivier can be seen, in the clip, using their daughter's car seat to shove Owens out of the way, causing him to fall to the floor. Following the incident, Owens was taken to a nearby hospital where he complained of abdominal pain.

According to TMZ, in the suit filed on Monday in Los Angeles, Owens says he wasn't blocking the couple's path and had every right to be standing where he was since, well, he works there. However, while he may be right, one angle of the video does show him taking a photo with what seems to be his cell phone.

In the lawsuit, however, Owens says that Martinez charged at him with full force without him provoking him in any way. He also accused the Oscar-winning actress of orchestrating the entire attack, saying she gave her husband "carte blanche ability to attack."

Following the attack, Owens filed a police report, but the L.A. city attorney refused to prosecute.
